(one)  If an offense detailed in subsection (b) is referred to some county company, delinquency proceedings less than this chapter will not be commenced right away. (two)  If treatment and social providers are unsuccessful when the dependency petition is pending, as evidenced by the kid's habits, plus the county agency thinks that juvenile justic
